GENERAL CONDITIONS OF ONLINE SALE

1. GENERAL PROVISIONS
These General Conditions of Sale must be considered valid only between the company Gilardoni S.a.s, with its registered office in Como (Italy), Via Cesare Cantù, tax code and VAT 00189630130, tel. +39 031.272111, e-mail address [email protected], here in after for the sake of brevity referred to as “Gilardoni”; and the natural / legal person, hereinafter for the sake of brevity referred to as “Customer”, who purchases online on the website www.gilardonicomo.it / www.gilardonicomo.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, D. 206/2005, as amended by Legislative Decree 21/2014 and by Legislative Decree 70/2003 on electronic commerce.

These conditions may be subject to changes by the company A. Gilardoni S.a.s. and the date of publication of the changes on the website coincides with the date of entry into force of said changes.
The Customer is required, before the conclusion of the purchase contract, to view these General Conditions of Sale which are understood as accepted at the time of purchase.

Therefore, the Customer is invited to print and keep the purchase order and the General Conditions of Sale in their records.

2. SUBJECT
These General Conditions of Sale govern the sale by Gilardoni and the purchase by the Customer of goods through the website www.gilardonicomo.it / www.gilardonicomo.com.

3. CONCLUSION AND EFFECT OF THE CONTRACT
3.1. Before concluding the purchase contract, the Customer undertakes to read these General Conditions of Sale which are understood to be fully accepted at the time of purchase.

3.2 The Customer also undertakes to examine the characteristics of the goods which are illustrated in the individual product pages. The graphic representation of the goods displayed on the website may not be entirely true to reality. The photographs of the goods, in fact, do not constitute a contractual element, as they are inserted for representative purposes only. The Customer, therefore, will purchase the product and will rely exclusively on the description of the essential characteristics published on the website.

3.3 The contract is concluded exclusively through the internet by the Customer’s access of the website www.gilardonicomo.it / www.gilardonicomo.com and the creation of a purchase order according to the procedure provided by the site itself and explained below.

3.4 Before proceeding with the purchase of the goods, the Customer must:

a) Complete the online order form by entering his/her/their personal data (name and surname / company name, tax code and / or VAT number when applicable, and email address);
b) insert in the shopping bag, by clicking on the appropriate button indicated by the symbol of a bag, the product (or products) he/she/they intend to purchase specifying both the size and the color;
c) indicate the address for the delivery of the goods (country, zip code, street name, house number and apartment number or staircase) for the delivery of the goods;
d) indicate any request to issue an invoice (for instance, for business or tax purposes) specifying: Company name, legal seat and / or address, tax code and VAT number;
e) select the payment method:

– Credit card (Visa, Master Card, American Express, Maestro, or PayPal)

f) accept the General Conditions of Sale;
g) transmit, through the site, the online order form which includes the obligation on the part of the Customer to pay the price of the order goods in favor to Gilardoni.

3.5 Gilardoni will send a notification of receipt of the online order form. The contract is concluded exclusively when Gilardoni provides confirmation, after verifying the data and regularity of the payment, of the shipment of the goods by DHL courier and the transmission by e-mail to the Customer of the package tracking number. The confirmation e-mail contains the Customer’s data and the order number, the price of the goods purchased, the shipping costs (where applicable) and the delivery address to which the goods will be sent.

The Customer has the responsibility to verify the correctness of their personal data contained therein and to promptly notify Gilardoni of any updates or corrections.

3.6 The purchase receipt will be sent as an attachment to the goods shipped.

4. DELIVERY TIMES, METHODS AND COSTS
4.1 Gilardoni undertakes to deliver the goods within 1-3 working days from the time the contract is concluded. These times refer only to shipments to addresses in Italy.
Confirmed orders will be shipped from Monday to Friday (until 5pm),
Those arriving on Saturday and Sunday will be processed on the following Monday.

4.2 Shipment will take place by DHL courier.

5. AVAILABILITY OF THE GOODS
5.1 The availability of the goods refers to the actual availability at the time the Customer places the order. This availability is merely indicative since, due to the possibility of the simultaneous presence on the site of multiple users, the goods could be sold to other customers before the order is confirmed.

5.2 Even after sending the order confirmation e-mail, there may be cases of partial or total unavailability of the goods and / or the impossibility of shipping. In these cases, Gilardoni will notify the Customer via a message and the order will be automatically corrected with the elimination of the unavailable item(s) and the refund of any amount paid for said goods. Gilardoni will not be held responsible, for any reason, due to the unavailability of an item (or some items).

6. METHOD OF PAYMENT
At the time of sending the onlinr order form, the Customer is obliged to pay the full price. The payment methods provided for the purchase of the goods are as follows:
– Visa, Master Card, American Express, Maestro credit card
– PayPal

The communications relating to the payment and the data communicated by the Customer take place on secured online transaction systems.

7. PRICE
7.1 The price of each good published on the site is expressed in Euros and includes VAT.

7.2 Shipping costs are not included in the purchase price, but are determined, if the shipment is not indicated as “free”, at the time of the conclusion of the online purchase form and before proceeding with payment.

7.3 Gilardoni may change the listed price of goods at any time. The price of the purchased goods corresponds to that indicated at the time of order confirmation.
In the event of an error in indicating the price of a product, Gilardoni will not consider the order valid and will send a communication to the Customer with the corrected price.

8. RIGHT OF WITHDRAWAL (RETURN OF GOODS)
8.1 In accordance with the provisions of laws in force, the Customer has the right to withdraw from the purchase, without having to provide any reasons, within 14 days from the date of receipt of the goods.

8.2 The Customer who intends to exercise the right of withdrawal must notify Gilardoni, within the aforementioned term, by means of an explicit declaration to be sent, by registered letter with return receipt, to:

8.3 In case of exercising the right of withdrawal, the Customer is required to return the goods to Gilardonii within 14 days from the date of the communication of the intention to withdraw from the contract pursuant to Art. 57 of Legislative Decree 206/2005.

8.4 Before proceeding to return the goods, the Customer must wait for the confirmation of acceptance by Gilardoni that, by e-mail, will send a label to be printed and glued on the package before shipment.

8.5 The costs of returning the goods are charged to the Customer.
The Customer can then contact the DHL courier or others couriers to request the collection of the goods.

8.6 The goods must be sent or delivered directly to the boutique: A. Gilardoni – via Cesare Cantù, 10, 22100 Como, Italy. 

8.7 In order to be able to return the purchased goods within 14 days of receipt, the Customer must comply with the following conditions:
– the clothing items must be returned intact, complete in all parts and with all  tags attached as originally;
– shoes must be returned intact (without marks or scratches) together with their original packaging, also not damaged, as an integral part of the product.

-the Customer must therefore ensure that the Products are intact and complete, that they have never been used, worn or damaged in any way, and returned in their original packaging, equipped with all the labels they were received with. In case a Product was provided with a security tag, the return of this Product will not be accepted if the original security tag has been removed, broken or damaged. The Customer is also informed that, based on security and hygienic-sanitary reasons, perfumes cannot be returned if the sealing cellophane and the original packaging have been opened, damaged, altered or removed.

8.8 The return of damaged, modified or used goods will not be accepted.

8.9 Without prejudice to the right to verify compliance with the above conditions, Gilardoni will refund the amount of the goods subject to withdrawal within a maximum period of 14 days through the same channel used for payment.

8.10 As required by Art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Gilardoni will refund within 14 days from the Customer notice withdraw from the purchase and within until receipt of the goods and after checking their conditions.

9.PRE-ORDER

9.1 You can get early access to the next season’s items before they’re released.

9.2 SHIPPING OF THE PRE-ORDER ITEM

As soon as your item has been released and is ready to be sent, you will receive an e-mail with the delivery date.

9.3 PAYMENT OF THE PRE-ORDER ITEM

Pre-order items require full payment at checkout.

9.4 PRE-ORDER WITHDRAWAL

The pre-order withdrawal is allowed by sending an e-mail to [email protected] before receiving the confirmation with the shipping date. If your item has already be sent, you have the right of withdrawal (return of goods – point. 8)

10. REGISTRATION
By registering their data, the Customer will have access to exclusive services including:
– Appointments, even by telephone, with a Personal Stylist
– Possibility of collection of purchases in boutiques
– Our newsletter with special offers.

11. CONFORMITY AND WARRANTY
Gilardoni is responsible for defects in the goods offered on the site in accordance with the provisions of Italian law.

12. LIABILITY
Gilardoni assumes no responsibility for inefficiencies attributable to force majeure (also known as “Acts of God”) or unforeseeable circumstances in the event that it fails to execute the order within the time stipulated in the contract.

13. PASSING OF RISK
The risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the Customer when the latter, or a third party designated by him/her/them and other than the carrier, materially comes into possession of the goods, i.e. at the time of delivery.

14. TREATMENT OF PERSONAL DATA
Customer data is processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to Art. 13 Legislative Decree 196/2003.

15. APPLICABLE LAW AND JURISDICTION
Italian law applies to these General Conditions of Sale. In the event of disputes relating to the purchased goods, the Court of Como will have exclusive jurisdiction.
